Why Call a Personal Injury Attorney after a Auto Accident

If you’ve been injured in a car accident, you may think you’re fine with just your initial medical bills being paid by the other person’s auto insurance. But before you dismiss the idea of contacting a personal injury attorney, there are a few things to consider.

Long-Term Effects

In the minutes, hours, and days following a auto accident, you may feel fine. Symptoms of whiplash take a while to emerge and spinal and muscle damage can take even longer. It’s important to have a thorough examination following the accident to make sure your symptoms aren’t mistaken for normal everyday aches and pains.

Insurance Companies

If the other person’s insurance company is being uncooperative or refusing to pay certain things, it may be time to seek a personal injury attorney. An attorney can work with the insurance company to make sure it knows the importance of responding to your requests. Often, simply being contacted by a personal injury lawyer can make all the difference in the responses you receive from the other party’s insurance company.

In addition to your medical bills, you’ll also need remuneration for time lost from work, keeping in mind that you have lost wages due to this auto accident. Property damage is only part of the personal loss you’ll suffer after a car accident. You may find you’re suffering emotional aftereffects and a personal injury attorney can help make sure you have payment to get the treatment you need.

Most often, a lawsuit will award compensation for medical bills and lost wages—items an insurance company is traditionally responsible for compensating. Often a personal injury attorney gets involved in cases where the at-fault party did not have auto insurance but medical bills need to be paid. While the injured party’s own insurance will usually pay for these expenses, in some cases the insurance company sues to get compensation for having to pay for these bills.

Fatality or Serious Injury

If the accident resulted in a death of your significant other, you’ll likely be dealing with issues like funeral expenses, loss of income leading to hardship, medical expenses, and severe emotional suffering. An Atlanta personal injury law firm can help make sure you get the compensation you need to pay for any treatment and take care of any expenses you’re incurring as a result of the accident.

If the accident was due to negligence, you may have an interest in making sure the person doesn’t get back on the road again. Compensation can’t guarantee that will happen, but it can help. In order to win your case against a driver, chances are you’ll have to prove negligence was to blame. If the person was under the influence or engaging in illegal distracted driving behaviors, this could help build your case. Be sure you get a copy of the police report concerning your accident before contacting a personal injury lawyer.

If you’ve been in a car accident, only you know when it’s time to consult a personal injury attorney. A personal injury attorney can help you get reimbursement for medical expenses and personal property damage, as well as other expenses incurred in a car accident.

If you or someone you love is the victim of  auto accident, you need to call one of the qualified attorneys at the Marks Law Group today. They will fight for your rights.

Common Types of Truck vs. Car Accidents in Atlanta

When an 18 wheeler collides with a car, major damage often ensues. Put a small car against an 80,000 pound tractor-trailer truck and the results can all too often be fatal. There are several common types of automobile accidents involving trucks and cars, each with its own causes and complications. Here are a few of the more common types of truck vs. car accidents.

Blind Spots

Trucks have much larger blind spots than cars, due in part to the size of the vehicle and in part to the height at which drivers have to sit. Known as the “No Zones,” truck blind spots include both sides, the rear, the front, and the space created when a truck tries to make a right turn. The general rule for the side No Zone is that if you can’t see the driver’s face in his rear view mirror, he can’t see you. Many truck vs. car accidents happen when a driver tries to switch lanes and doesn’t see a car in his blind spot.

The truck’s rear No Zone takes up as much as 100 feet behind the truck, which explains the warnings painted on the back of many trucks. The problem with tailgating tractor-trailer trucks is that you run the risk of the truck’s driver braking suddenly, causing a rear collision accident  that can do far more damage to the front end of your car than a traditional rear-end collision.

The front No Zone of a truck simply reiterates the importance of not pulling too sharply in front of a truck. It’s important to understand that large trucks take quite a while to brake, which means you could find yourself rear-ended by a truck if you pull in front of one and come to a sudden stop.

The final No Zone, involving the wide space trucks need for right turns, tells drivers not to try to squeeze in to the side of a truck when a driver is attempting one of these tricky turns. The driver can’t see to the right or left side of him at that point, which creates another accident danger zone and can cause a side impact accident.

Overloaded Trucks

When a truck is carrying more weight than it is supposed to carry, it’s a recipe for disaster. A too-heavy load can increase a truck’s momentum, especially when going downhill, making it harder for the truck to stop. It also throws the truck off balance on curves, which can make it more likely to tip over.

Most states have weight limits for trucks, so when a truck is involved in an accident due to overloading, the authorities will generally determine the weight to see if the driver is in violation. Weigh stations are generally set up along Interstates to help prevent these potentially fatal accidents.

The driver isn’t the only one responsible for ensuring loads are appropriate for the roads they will be traversing. In fact, the trucking company may share in the liability if an accident happens due to overloading. It’s important for trucking companies as well as drivers to understand the dangers of carrying heavy loads.

Understanding Georgia’s Texting and Cell Phone While Driving Laws

As in most states, texting and driving is illegal in Georgia. Naturally, this is tough for law enforcement officers to enforce, but if a driver is spotted texting, a fine of $150, plus penalty points, will be issued. Cell phone use by adult drivers in Georgia is still allowed with a few exceptions, but as with many states, this law is subject to change in the coming years.

Drivers Under 18

In Georgia, a “novice driver” law applies to cell phone use. Drivers under the age of eighteen are not allowed to use cell phones, even through a hands-free device like a Bluetooth earpiece. The fine for this is $150, as with texting, and if a teen is involved in an accident while texting or on the cell phone, the fine doubles.

School Bus Drivers

Aside from underage drivers, bus drivers are banned from using cell phones. Specifically, school bus drivers may not use cell phones (handheld or hands-free) while loading and unloading students or while the bus is in motion.

Texting while driving is also illegal for school bus drivers, falling under the general law for all drivers.

Texting and Driving

Georgia is one of many states where texting is now illegal while driving. As mentioned above, texting is a difficult offense to spot, but behaviors usually associated with texting while driving like swerving and rolling through stop signs are usual indicators. The most common accident associated with texting while driving is a rear end car accident. Even if someone is pulled over for reckless driving behavior and texting was at fault, an officer may have a difficult time proving texting was the cause. As officers have stated to the press, most of the time when the driver is asked, they simply respond they were dialing a number. In most states, dialing a phone number while driving still is not illegal, even though it has been proven to be just as dangerous as texting.

Often, texting and driving is only pinpointed when the behavior results in a fatality. At that point, cell phone records may be called upon. Unfortunately, too many fatalities each year result from texting and driving, especially in younger drivers, leaving law enforcement officers with no way to stop this behavior other than education.

Other Phone Uses

Obviously, we now live in a world where texting and talking on a phone aren’t the only dangers on the world. Drivers are tweeting and Facebooking, as well as checking e-mail and inputting data into GPS devices. Even voice-to-text features designed to make cell phone use while driving safer fail in most cases, as drivers look down at the screen to make sure commands are executed.

But in many states, dialing while driving is considered part of regular cell phone use, whether handsfree or handheld. As long as cell phone use is still allowed in moving vehicles, dialing and driving will still be legal, or so it appears. Yet, with dialing being just as distracting as texting, checking e-mail, and inputting data into GPS devices, drivers need to be aware that it even if it is legal, it is still extremely dangerous and could result in a serious car accident.
